A recent directive from Texas authorities has prohibited the employment of unmanned aerial vehicles, commonly known as drones, for the purpose of bait deployment in fishing activities. This ruling specifically impacts practices such as shark fishing from coastal areas, where drones have become increasingly popular for reaching further waters. The decision by the Texas Parks and Wildlife Department (TPWD) clarifies that such usage falls under existing federal statutes.

The core of this prohibition stems from the Federal Airborne Hunting Act (AHA), a piece of legislation initially conceived in 1956 to curb hunting from traditional aircraft like helicopters and fixed-wing planes. However, its broad interpretation of 'aircraft' now encompasses modern drone technology. According to officials, the U.S. Fish and Wildlife Service's Office of Law Enforcement confirms that drones, when used to carry and release bait, are aiding in the 'take or attempt to take wildlife'—a term that legally includes fish. Consequently, any attempt by state bodies to authorize such activities through permits is nullified, as the federal act explicitly forbids states from issuing permits for sport hunting, which extends to recreational or sport fishing.

This interpretation has generated considerable discontent within social media groups dedicated to surf fishing, as many enthusiasts previously relied on drones for this method. The TPWD encourages all anglers to thoroughly review current regulations to ensure adherence before participating in fishing activities.
